Intrepid Recovery Centers (“Intrepid,” “we,” “us,” or “our”) operates a recurring SMS text messaging program to communicate with individuals who have voluntarily opted in to receive messages. These Terms & Conditions (“Terms”) govern your participation in the Intrepid Recovery Centers SMS program and constitute a legally binding agreement between you and Intrepid Recovery Centers.

2. Consent to Receive SMS Messages
By providing your mobile telephone number and affirmatively checking the SMS opt-in consent box on any web form, intake form, or other contact mechanism operated by Intrepid Recovery Centers, you expressly consent to receive recurring automated and/or manually dialed SMS text messages from Intrepid Recovery Centers at the mobile number you provide.
2.1 Consent Is Not a Condition of Service
Consent to receive SMS messages is never required as a condition of receiving any service, treatment, admission, or other benefit from Intrepid Recovery Centers. You may decline to provide your mobile number without affecting your eligibility for services.
2.2 What You Are Consenting To
By opting in, you acknowledge and agree that:
You are the subscriber or authorized user of the mobile phone number you provide.
You are at least 18 years of age.

Important: Intrepid Recovery Centers will NOT include Protected Health Information (PHI) or substance use disorder treatment information in any SMS message unless the recipient has provided a separate, specific written authorization for such disclosure as required under HIPAA and 42 CFR Part 2. Recipients are advised not to include PHI or sensitive health information in any SMS replies sent to Intrepid Recovery Centers.
4. How to Opt Out (Stop Receiving Messages)
You may opt out of the Intrepid Recovery Centers SMS program at any time using any of the following methods:

Mobile opt-in data and consent records are not transferred to any third party under any circumstances. This prohibition applies regardless of any other information-sharing provisions in our Privacy Policy.
6.4 Data Retention
Intrepid Recovery Centers retains SMS-related data including mobile phone numbers, opt-in timestamps, consent records, opt-out records, and message logs as required for regulatory compliance, internal auditing, and carrier compliance purposes. Individuals may request access to or deletion of their SMS-related data by submitting a written request to our Privacy Officer.
7. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Intrepid Recovery Centers is not responsible for any delays in the delivery of messages caused by your wireless carrier, network outages, or technical issues beyond our control.

9. Changes to These Terms
Intrepid Recovery Centers reserves the right to modify these Terms at any time. Any material changes will be communicated to enrolled participants via SMS or posted on our website at www.intrepidrecovery.com prior to taking effect. Continued participation in the SMS program following notice of changes constitutes acceptance of the updated Terms.
